Terms of Use
1. Acceptance of Terms
By accessing or using sonos (Service), you (User) agree to be bound by these Terms of Use (Terms). If you do not agree, do not use the Service. We reserve the right to modify these Terms at any time. Where changes materially affect your rights or obligations, we may provide notification via email or a notice on our website.
2. Description of the Service
dicta is a web-based platform that converts text-based content into audio. Users input their legal or non-legal text, pay a fee based on text length, and receive a citation-free audio version by email. The Service is provided “as is” and is not intended to provide legal advice or certify the accuracy, completeness, or reliability of the converted content. We may update, modify, or discontinue any aspect of the Service at our sole discretion.
3. User Responsibilities
Right to the Text: By uploading or submitting text, you certify that you have all necessary rights and permissions to convert that text into audio.
Compliance: You are responsible for ensuring that your use of the Service (and the resulting audio) complies with all applicable laws, including copyright laws, fair use/fair dealing exceptions, or other relevant regulations.
Prohibited Uses: You agree not to use the Service for any unlawful or malicious activities. We do not actively monitor or filter user-submitted text and assume no liability for any misuse or infringement.
4. Payment and Refunds
Payment Processing: Payments are handled via a third-party service. We do not collect or store your payment details.
Refund Policy: Refunds will be considered only if you notify us within fourteen days of purchase of any errors and allow us an opportunity to correct them, unless time constraints make correction unworkable. While we will consider the circumstances leading up to a request, we reserve the right, at our sole discretion, to grant or deny any refund requests.
5. Disclaimers (No Legal Advice)
No Legal Advice: We are not a law firm, and the Service is not a substitute for legal counsel. This much is obvious.
Accuracy: While we strive for accuracy, you acknowledge that unintentional omissions, inaccuracies, or mispronunciations may occur. Content provided through the Service should not be relied upon as fact or legal advice.
As-Is Basis: Except as expressly provided herein, the Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
6. Limitation of Liability
To the maximum extent permitted by law, we (including our affiliates and representatives) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses, even if we have been advised of the possibility of such damages.
7. Indemnification
You agree to indemnify, defend, and hold harmless dicta and its affiliates and representatives from and against all claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising out of or related to any text you submit, your use of the Service, or your breach of these Terms or any applicable law.
8. Termination
We reserve the right, at our sole discretion, to terminate or suspend your access to the Service at any time, with or without notice, for any reason, including violation of these Terms or suspected illegal activity.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada or, where applicable, the Province of British Columbia, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts of British Columbia, Canada, for the resolution of any disputes.
10. Modifications to the Terms
We may revise or update these Terms at our discretion. If changes materially affect your rights or obligations, we may notify you via the email address you provided or by placing a prominent notice on our site. Your continued use of the Service following any updates constitutes acceptance of those changes.
